Mcgough, a coke drawer at Spen Colliery, on February 5, 1893, while following his employment, he was crushed against the becoh wall by a truck running amain in the coke yard. Spen Colliery was owned by the Consett Iron Works at the time.

He was employed by the Consett Iron Company at the time of his death and his six children successfully sought damages under the Employer's Liability Act in respect of his death. £200 was awarded : eldest girl £20 ;the eldest boy £10 ; the next boy 15 years of age £10 ; the next boy 13 years of age £40 ; next boy 8 years of age £50 ; and the youngest girl 5 years of age £70 .
